What is the difference between joint proprietors and tenants in common?
These are two different ways people can legally own property together. If you own property as joint proprietors, each owner has an equal interest in the whole property, and if one owner dies, their interest usually passes automatically to the surviving owner. If you own property as tenants in common, each owner holds a separate share in the property, which can be equal or unequal, and that share does not automatically pass to the other owner.
Can two people own a property in different shares?
Yes. If a property is owned as tenants in common, each person can own a different share. For example, one person may own 60% and the other 40%, depending on what has been agreed.
Can I force the sale of a jointly owned property?
In some circumstances, yes. If co-owners cannot agree, one party may apply to the Court for an order that the property be sold. Whether this is appropriate will depend on the specific situation.

A property dispute arises when there is a disagreement about ownership, sale, use, or financial contributions relating to a property. These disputes can occur between co-owners, family members, or business partners.
