What does the Court look at in parenting cases?
The Court focuses on the child’s best interests, including safety, relationships with each parent and practical arrangements that meet their needs. We’ll explain how this applies in your situation.
Do I have to go to mediation first?
In most cases you must attempt family dispute resolution before filing in Court, unless there are urgent or risk issues. We can advise which pathway is appropriate for you.
Can children choose which parent they live with?
Children’s views can be considered, but they do not simply choose. Their wishes are usually gathered through reports or professionals, not direct questioning by parents. We’ll explain how this works.
How are parenting orders different from a parenting plan?
Parenting orders are binding and enforceable by the Court, while parenting plans are flexible agreements. We can advise which option suits your circumstances and help document the arrangements.
What if I am worried about family violence or safety?
If safety is a concern, we can advise on intervention orders, urgent parenting arrangements and safety planning, and prioritise steps that protect you and the children as much as possible.
If I have a concern, can I go straight to Court?
In most cases, you are required to attempt family dispute resolution (mediation) before applying to the Court. However, there are exceptions. If the matter is urgent or involves issues such as family violence, risk to a child, or other serious circumstances, the Court may allow you to proceed without first attending mediation.
