When is it appropriate to make a claim to the Small Business Commission or Tribunal?
It may be appropriate to seek help when your business dispute cannot be resolved directly, and the matter is suitable for dispute resolution or a formal claim. In Victoria, many small business disputes are first dealt with through the Victorian Small Business Commission (VSBC), which offers information, preliminary assistance and mediation. Depending on the type of dispute, the matter may then proceed to VCAT or a court. Some disputes, including certain retail leasing matters, must first go through the VSBC before they can be heard by VCAT.
If I have a business dispute, who decides it?
That depends on the type of dispute. Some business disputes are resolved by the parties themselves, either directly or with the help of lawyers or a mediator. In Victoria, the Victorian Small Business Commission (VSBC) can assist with mediation, but it does not make binding decisions. Some disputes may instead be decided by an expert or an arbitrator, if that process is required under a contract. Other disputes may be decided by VCAT or by a court, such as the Magistrates’ Court, County Court, or Supreme Court, depending on the nature and complexity of the matter.
Do I have to try mediation before starting formal proceedings?
In many business disputes, it is sensible to try to resolve the issue directly first. In Victoria, the VSBC encourages parties to attempt early resolution and offers dispute resolution services, including mediation. In some types of disputes, such as certain retail leasing matters, involvement with the VSBC may be required before the matter can proceed to VCAT.
