How can I challenge a power of attorney?
A power of attorney can be challenged if there are concerns about how it was made or how the attorney is acting. This may include issues such as lack of capacity, undue influence, or misuse of authority. In Victoria, an application can be made to the Victorian Civil and Administrative Tribunal (VCAT) to review, suspend, or revoke a power of attorney.
What happens if there is no valid power of attorney and the person has lost capacity?
If a person no longer has capacity and does not have a valid power of attorney in place, an application can be made to VCAT to appoint a decision-maker, such as an administrator or guardian, to manage their affairs.
Can more than one person be appointed as attorney?
Yes. You can appoint more than one attorney and decide whether they must act together or can act independently. It is important to choose an arrangement that works practically and avoids conflict.
