All hearings are currently still proceeding in the Family Court of Australia, albeit via either telephone or Microsoft Teams. Generally, the smaller (and less complex) hearings proceed on the telephone and the more heavily contested hearings proceed through the use of Microsoft Teams, where the court can visibly see each lawyer that is involved in the hearing.
The Magistrates’ Court is operating differently to the Family Court of Australia during this COVID pandemic. The Magistrates’ Court is the court that hears most Intervention Order (IVO) matters. The Magistrates’ Court is currently only open for urgent cases. It generally is not open at this time for contested Intervention Order hearings and accordingly most IVO contested hearings are being adjourned to a date later this year, or for 2021.
